Terms & Conditions

1. Definitions
• “Company” refers to JAYMARC Industries.
• “Client” refers to the person or entity purchasing Goods or Services from the Company.
• “Goods” refers to pool fencing, balustrade systems, shower screens, hardware, and related products supplied by the Company.
• “Services” refers to installation, site preparation, measurement, fabrication, and associated works performed by the Company.
• “Agreement” refers to the contract formed when the Client accepts a quote or places an order.

2. Scope of Work
2.1 The Company will supply the Goods and perform the Services as outlined in the accepted quote or written agreement.
2.2 Any work not expressly included in the quote — such as demolition, waterproofing, structural carpentry, electrical work, plumbing, or additional materials — will be treated as a variation.
2.3 Variations must be approved by the Client and will be charged at the Company’s standard rates.
2.4 For shower screens and balustrades, the Client acknowledges that final measurements may require adjustments to pricing or lead times.

3. Quotes & Pricing
3.1 All quotes are valid for 90 days unless otherwise stated.
3.2 Pricing is based on the information and measurements available at the time of quoting. If site conditions differ from what was disclosed or reasonably expected, the Company may revise the quote.
3.3 Prices include GST unless stated otherwise.
3.4 Custom fabrication of pool fencing, shower screens and balustrade panels is non‑refundable once manufacturing has commenced.

4. Payment Terms
4.1 A deposit (percentage specified by the Company) is required to secure materials, fabrication, and installation scheduling.
4.2 The balance is payable upon completion of the Services.
4.3 Late payments may incur interest and recovery costs.
4.4 Goods remain the property of the Company until full payment is received.

5. Installation Conditions
5.1 The Client must ensure the site is accessible, safe, and ready for installation.
5.2 The Company is not responsible for delays caused by weather, site access issues, or third‑party contractors.
5.3 If underground services (water, power, gas, data, etc) are not clearly identified, the Company accepts no liability for accidental damage.
5.4 For shower screens, the Client must ensure waterproofing and tiling are completed and cured before installation.
5.5 The Client is responsible for ensuring that the substrate is structurally sound and suitable for the installation of balustrades. Waterproofing must be completed after the spigots or posts have been installed. If waterproofing is applied prior to installation, JAYMARC cannot guarantee the integrity or ongoing performance of the waterproofed surface.
5.6 The Client is responsible for obtaining any required approvals unless otherwise agreed in writing.
5.7 When core drilling into concrete or pavers, a high volume of water is required to cool the diamond‑tipped drill. During this process, fine concrete dust or steel reinforcement particles may mix with the water and can occasionally stain the surrounding surface.
All reasonable care is taken to minimise this; however, in the event staining occurs, it is the Client’s responsibility to clean the affected area. Please contact your paving supplier for advice on removing concrete residue or rust‑related staining.
JAYMARC accepts no responsibility for surface staining resulting from the drilling process.

6. Compliance & Standards
6.1 All Goods and Services will comply with relevant Australian Standards, including but not limited to:
• Pool fencing regulations
• AS1288 (Glass in Buildings)
• AS1170 (Structural Design Actions)
• Applicable state and territory building codes
6.2 The Company installs products to meet compliance at the time of installation.
6.3 Ongoing compliance — including maintenance, gate operation, vegetation control, structural changes, or environmental changes — is the Client’s responsibility.

7. Warranty
7.1 The Company provides a warranty on Goods and workmanship as outlined in the quote or product documentation.
7.2 Warranty does not cover:
• Misuse, neglect, or improper maintenance
• Damage caused by external contractors
• Environmental factors (corrosion, ground movement, storm damage)
• Glass breakage caused by impact, misuse, spontaneous explosion or structural movement
• Modifications made by the Client or third parties
7.3 Warranty claims must be submitted in writing with proof of purchase.

8. Liability
8.1 To the extent permitted by law, the Company’s liability is limited to:
• Repair or replacement of Goods, or
• Re‑performance of Services
8.2 The Company is not liable for:
• Consequential or indirect loss
• Delays outside its control
• Damage arising from inaccurate information provided by the Client
8.3 Nothing in this Agreement excludes rights under the Australian Consumer Law.

9. Cancellations
9.1 Orders cancelled after materials have been purchased may incur restocking or supplier fees.
9.2 Custom‑made items cannot be cancelled once fabrication has commenced and must be paid for.
9.3 Cancellations within 48 hours of scheduled installation may incur a call‑out or labour charge.

10. Site Conditions & Damage
10.1 The Company will take reasonable care to avoid damage to property.
10.2 The Client acknowledges that installation may cause minor disturbance to landscaping, soil, tiles, plaster, or existing structures.
10.3 The Company is not responsible for pre‑existing defects, structural issues, or movement in substrates.

11. Maintenance
11.1 The Client is responsible for ongoing maintenance of the installed products, including:
• Cleaning
• Lubrication of hinges
• Tightening of hardware
• Ensuring gates self‑close and self‑latch
• Ensuring balustrade fixings remain secure
• Ensuring shower screens are cleaned and maintained to prevent corrosion or mould
11.2 Failure to maintain the products may affect compliance and warranty.

12. Privacy
12.1 The Company collects personal information solely for the purpose of providing Goods and Services.
12.2 Information will not be shared with third parties except where required to fulfil the Agreement or by law.

13. Governing Law
13.1 This Agreement is governed by the laws of Australia, and any relevant state or territory in which the Services are performed.
13.2 Any disputes will be handled in the appropriate jurisdiction.

14. Acceptance
By accepting a quote, paying a deposit, or placing an order, the Client agrees to these Terms & Conditions.
